    Default Accused of Shoplifting at Walmart

    My question involves criminal law for the state of: IL


    So I went to walmart and was looking for shampoo and conditioner for my gf. So while i was tryin to call her, i went and picked up deodorant from the shelf. I seen this guy watching me but thought nothing of it cause i hadnt done anything. Anyways I walk around and eventually throw the deodorant box in a can. Also i had grabbed shampoo and conditioner. When they claim these items were "taken" I was not in camera view. Well the lp said he saw me and a year and a half later a detective called me and I told him what i was doing there and that I dont recall taking anything. I told him yes i picked the items off the shelf but i never took them. The lp claims i did. Now one more thing id like to add is the lp tried to stop me in the parking lot and i had stopped to talk to him til a black walmart employee started to stride towards me in which case i ran. They say i dropped the deodorant in the parking lot which two people were with me and when the guy got back from chasing me, had nothing. The LP guy then tried to keep the two people with me and make them come inside in which they refused and left. The lp also claimed that i took the shampoo and conditioner and put it in my jacket. This is all based on what he says he saw. Their is no evidence on camera of me taking anything. Whats funny is the detective claimed i bent down in the aisle to take the deodorant which is not true at all. I told him maybe i bent down but i know for sure i didnt take anything so basically what he told me is i took the deodorant but the lp doesnt know where i concealed it and i took shampoo and conditioner so on what basis did the cops have to issue a warrant for my arrest and how far will this go in court? This is retarded and just a pain in the behind. Whether i took it or not is not the issue, making accusations with is the problem. I mean seriously our tax dollars pay for a detective to pursue a theft of maybe 10 dollars with little to no evidence. They have video of me getting there and picking items off the shelf but no evidence of me taking it nor dropping anything in the parking lot.
    For the record the camera DID NOT see me do anything from what the cop said. This guy didnt see me directly take anything either. He claims he saw me in which he most definitely did not. The detective said the LP thinks he saw me crouch down to take it in which i didnt. He didnt see me drop anything either in the lot either When they came back from chasing me they did not have anything so he couldve claimed this too. My two witnesses were right there when the guy came back from chasing me. Nothing was on camera for sure except getting out of the car. secondly when he claims i took shampoo and conditioner i had thrown them in the clearance aisle of that walmart cause i wasnt gonna get them. He says i put them in my jacket which i didnt. He lost line of sight on me 2 to 3 times. I think he saw me with the items and when he didnt see me with the items he assumed I took them.

    Also would it be me and my two witnesses word against this LP's word cause I plan on fighting this. I mean how can they say I took something just based of what he claims to have saw. I say i didnt take it, he says i did. So my word against his. I thought our law is guilty beyond a reasonable doubt. I hardly think this situation qualifies as beyond a reasonable doubt. How convenient he "found" the deodorant after everyone left. Im sure he will have the black guy in there to testify he was with the lp in the lot when he found the deodorant I "dropped" why wouldnt he? If I was the black guy I would to. I do the store a favor, they move me up. Perfect! And as far as I know an LP has to maintain a line of sight from the moment he sees the item taken til the person walks out. This for sure didnt happen cause when i walked out the garden shop he was nowhere around. Garden shop is pretty open. Please let me know where I stand. Im gonna turn myself in this week. Also If your not gonna say anything that is helpful please keep your negative comments to yourself as I know a bunch of LP's or LP wannabe's come on here and automatically claim some people are guilty. Obviously any lp can say something happened and try to screw you over. If i can get this dropped without all the court crap then ill leave it alone but if these a&*holes drag this on and i have to miss work, Im gonna sue them for making false claims.

    Well I was waffling whether to believe you (especially with wierd statements such as "i dropped the deoderant in the can", what can? where? Why would you do that).

    When I got to your pre-emptory insult, I'll just go away. The LP testimony will generally be persuasive in court. If that's all you're basing your defense on, I don't give you much hope. You definitely need a lawyer.

    "Whether i took it or not is not the issue, making accusations with is the problem." Since avoiding a conviction for theft is a concern,that is your concern and if they can prove it. I agree it's a waste of time and ridiculous to peruse the matter a year latter for such a minor offense but since they choose to peruse it's irrelevant. If you did steal the stuff then man your just lucky and do deserve to get arrested. Since they filed this a year after the fact,I doubt it will be dismissed with out going to court.

    It looks like you are probably gonna have to turn yourself in and then appear in court. If after the 1st appearance they don't just dropped,I would hire a lawyer if your unable to get a legal aide. If the case get thrown out in court and you actually are innocent I would take to lawyer and see if a lawsuit is possible. Shoplifting is a big problem but Lps and certain stores need to learn be more careful that innocent are accused,arrested and harrased. In that case they should be punished.
