    Default Virginia Reckless Driving Charge

    I was just involved in a single-car accident while driving home from work. Basically, I was driving into the sun for awhile, and I fell asleep momentarily. This resulted in my plowing through a board fence and totalling my car. Unfortunately, I was charged with reckless driving (46.2-853), and I can honestly say that I was NOT driving while fatigued. What are my options here, short of hiring a lawyer? (Entirely too expensive, but I will, if jail time is likely in this scenario).

    You need to have a physical. There may be a medical situation involved. Sleep apnea may be a possibility, especially if you are overweight and snore.
