Expungement of a theft by check in Texas

I was charged with theft by check, but the charges were dismissed because I paid the checks off. Am I still eligible to have my records expunged even though I was arrested for it. And what is the process and price range I would have to go through in order to have this accomplished.

From what you have described it appears you would be eligible for an expunction under Texas law. What I would suggest is contacting the court clerk where your case occurred to obtain the disposition of your case. You can then contact an attorney and get some quotes on fees--I've heard of upwards to $1,500.00 quoted for doing an expunction but do check around.

The process involves filling out doucments and a petition for expunction which is filed with the Court. A hearing is held and if all is in proper order the Court enters an order granting the expunction.
