    Default Wrongly Noted for Excessive Speed on an Accident Report

    My question involves a traffic accident in the State of: North Carolina. I was involved in a traffic accident on a two way divided road in which i was crossing an intersection with no traffic light but i had right a way going straight. there were two trucks in the left turn lane beside me partially obstructing my view but as i entered the intersection a vehicle on the opposing side making a left turn crossed the intersection in front of me I slammed on the brakes but still T boned her.

    The officer on scene quickly took both our information and then proceeded not to write any citations. when i asked him about it he said if he writes her a ticket for failure to yield then he has to write me one for "excessive speed". I know 100% without doubt i was not speeding, it didn't help she was a pretty young lady.
    my question is i only have liability on my car and now since the report says i was excessively speeding her insurance is fighting not to pay my claim. I've tried to talk to local PD to get them to further investigate it but they wont listen and now it seems like i will get completely screwed over. can anyone recommend where to go from here? Thanks

    The officer noted his impressions on the report. If you disagree with those assessments, argue your case to the insurance companies. Their assessment of fault is independent of the officer's.

    Is YOUR insurance involved too?

    If it is you alone trying to battle her insurance, they will sense weakness and fight.

    If your insurer is helping you- perhaps they agree with you that she was "80%" at fault (or whatever) they will help press a claim.

    If it is you alone, press your case with the insurer, say the officer never cited you and you do not think your speed was the causal factor....
