    Default Is a Contract to Return Stolen Goods Void

    My question involves personal property located in the State of: Florida

    My "friend" stole very valuable parts of my late wife inheritance, parts of a collection, she is claiming, the thief, that the deceased gave it to her as a present. I know that the only way for me to get my things back is to sign a contract with her for a purpose of joint venture in regard of the sale of the entire collection, thus recover my property, declare the contract is void and worthless, and then go to the police.

    If I was first to go to court and or the police, the crock will not discover her hide and would rather burn it than to return it to me.

    Such a contract could be viewed as written evidence, signed by you, that the items at issue aren't yours.

    Such a contract would also demonstrate that it is a civil matter and you would NEVER get any police agency to take any criminal action. You are seriously clueless about how things work.

    You can't just "declare" the contract void. What are you? 12?

    The only contract that can be declared null and void upon its face is something that is inherently illegal, like a contract for an illegal interest rate, or something requiring criminal conduct. Also a contract that is contrary to public policy; which is way over your head.

    Can you prove that the collection was stolen beyond a reasonable doubt?
    If not, then no criminal charges will result.

    Can you prove in civil court that the collection was stolen by a preponderance of the evidence? If you can, do you have the money to pursue a civil action and the time?
