    Default Erroneous Charge to a Credit Card

    During the MTA strike last December, I was forced to order a limo service to the airport. Myself and a colleague, who traveled together, paid the limo driver $80 in cash and were NOT issued any form of receipt. While booking for the limo over the phone, I was asked for my credit card number but was promised that it would ONLY be charged in the event of a no-show. I picked up the charge on my credit card, unfortunately, several months later and have called the limo company at least 8 times to report the issue. During the first few conversations they promised to look into it and get back to me. They never came back. As I continued to pursue the issue, I was met with some luck. One employee told me that they had records of the credit card charge and records showing that the driver had collected the fee in cash, and promised that the credit card charged would be reimbursed. However, this never happened. They are now saying that they cannot refund the amount as there are no records showing that the driver was paid in cash. The driver was a part-time employee, employed during the strike. They claim that they have no details about his whereabouts now. Yet they continually claim that the driver said that I had not paid him in cash.
    What are my options, if any?

    Probably small claims court.
