My question involves a speeding ticket from the State of: California
I received a ticket on NB 101 in San Francisco right after the speed limit changes to 50mph for going 65+. The officer cited me on VC22349(a) and actually didn't pull me over until well off the freeway since my exit was 100 yards after the speed limit changed. He told me I was actually doing 70 but he would mark the ticket at 65+. I'm assuming he paced me because I have fairly decent radar detector and the Ka band did not go off. I unfortunately wasn't paying close attention so I don't know what speed I was actually going when I exited the freeway. He also asked if I have had any tickets in the last 18 months and when I replied no, he said that's good I would be able to take traffic school.
The ticket just lists 65+ but doesn't mention what the speed limit is in this area. The bail amount is $466 which seems about $200 more than the amount when over the limit by 16-30mph as listed in the California Uniform Bail and Penalty Schedules. San Francisco County is not listed as one of the 30 counties allowed to exceed the maximum bail amount. I should not have any points on my record.
1) For going 65+ in a 50 zone, is that in the 1-15mph or the 16-30mph bail schedule amounts?
The actual table is this:
22349 (a) I Speeding 1–15 MPH Over 65 MPH Limit 35 40 28.00 8 20.00 7 8 146.00 + 4a 1
22349 (a) I Speeding 16–25 MPH Over 65 MPH Limit 70 70 49.00 14 35.00 14 14 266.00 + 4a 1
Judging by that description, I would actually just be in the 1-15 over?
2) I really just want to get this fine reduced, I don't want any points on my record. Would it be best just to plead guilty and asked for a reduced fine? Would this still require a court hearing? If I plead not guilty and fight the ticket and lose, is it possible to still have the fine reduced?
3) Any idea why the bail is so high?
