    Default Extradition on Misdemeanor Charges

    My question involves an arrest warrant from the State of: North Carolina. I got arrested 11/24/09 for eluding speeding and driving w/o a license. The mailman came to my door w/o the proper warrant. Will PA extradite on misdemeanor charges. The issuing county also changed the charges to two driving w/o. Can they do this? I think they are trying to get me as a habitual felon. Any answers please!

    It's unlikely that they'll extradite for a misdemeanor, but if you choose to blow off a warrant you'll have to wait and see what happens. If you're stating that you're also wanted for violation of felony probation, or if the charges are felonies, all bets are off.

    Yes, the prosecutor can amend the charges against you.

    Actually, it's a gamble as to whether PA will come get you. Sometimes the investigators for the DA's office are eager for a road trip and NC is within a days drive of home.

    Even if they don't come get you, that warrant may continue to bite you. If you get stopped for a traffic violation and it comes up, they may lock you up until they again inquire from PA if they want to come get you.

    Charges don't go away with time. I would recommend consulting with a lawyer up in PA rather than guessing what you are up against. Further if you were suspended in PA, how is it that you have an NC driver's license now? It's only a matter of time before NC starts locking you up as well.

    I would also guess that your license has been suspended.

    You don't want to get popped for driving on a suspended license...the fines rival those of DUI.
