My question involves landlord-tenant law in the State of: New York.
I rented a house in East Hampton and signed a written lease from the Landlord who lives in New York City. I reside in Nassau County, NY. The lease states that the security deposit will be returned within 45 days. Today marks the 45th day.
1) Where do I sue? In New York City, Nassau County or Suffolk (the location of the house).
2) Can I sue for more than the amount of the security deposit and if so, how much?
3) During my stay in the rental there was a tornado in the area resulting in loss of electric power debris from fallen big trees on the property including porch, and barbecue area. The lease states as follows: Landlord shall not be liable for any injury loss, damage to the tenant's property or to any person who uses the premises. Can we sue for the two days we did not have electicity and the use of the property. The Landlord was aware of the tornado and the damages but she failed to come out to check and/or rectify the situation.
4) She advertised that the rental had a washer/dryer and computer with broadband access. But when we got there she did not allow us to use the washer/dryer and demanded a charge for use of the computer. Can we sue for this too?
