    Default Getting Phone Records With a Subpoena

    When you obtain phone records from a phone company via a subpoena..does the individual that the phone records belong to have any knowledge of this?

    It's going to depend upon the full context of the case including the state involved, whether it's a civil or criminal matter and whether or not the subject of the subpoena is a party.

    Normally in a civil case, the subject of the subpoena would get notice and an opportunity to try to oppose or limit the subpoena.
