    Default Is a Restraining Order Considered 'Small Claims'

    My question involves restraining orders in the State of: Florida.

    I sued for an injunction for a permanent restraining order. I ended up with a temporary restraining order after facing the judge.

    Is this considered "small claims"?

    as far as I know, if I am reading this right?? a ro/tro is held in supreme court, you file for a TRO and that is given untill a date at wich time all parties come back to court and decide if a order of protection will be issued.

    If it is getting the order you are trying to do there isnt any suing that I know of???

    in my mind I use sued for a court proceding trying to get money or assets.

    Scarlett, Florida does allow for certain types of injuctive relief to be granted in a small claims court, but injunctive relief may also be granted by a regular civil trial court or by a family court. If you brought your action in small claims court it was a small claims case; if you brought it in a different court it was not a small claims case. So you tell us: Was your action in small claims court?

    It was likely filed in civil court, under domestic relations section, or family court.
