    Default Computer Seized in Warrant - How Do I Get Back

    My question involves criminal law for the state of:Illinois
    Ok I hope some one could shine some light on this matter. Here is the story I rented a room for rent from a house that rented rooms for rent me and 3 other guys plus the home owners son named Brett. We all had computers in each room and shared the same wireless connection off a net-gear router. About 3 months ago the house was raided and all my electronics that was worth money was taken by the police Cary IL police department. Every body's computer was taken in the house of possible Child porn, me and the other 2 guys knew it was the owner's son named Brett that was downloaded the child porn. My question is after he is convicted how do I get all my stuff back ? Thank you for your time.

    There's no easy answer to that. Why does the prosecutor believe it's necessary to hold the computer equipment of people not alleged to be part of the crime? Were the other computers used by the defendant?

    as far as I know they could not tell who was downloading the child porn since Comacast has a IP for that address then the router shares the connection but I would have thought the same since each IP of a computer is different. To me since he rented out rooms for rent it would be like a hotel if a person is doing something illegal do you take every computer in the hotel ? But he will get whats coming to him, I just want my stuff back 1 desktop 1 laptop 1 router 1 USB drive my 20' monitor that holds no information , my MP3 player, my video camera , my external hard drive, as I stated I do computer repair for a living and these where my tools. I'm just so angry I know my PC's and stuff have none of that illegal CP porn I'm no sicko but the owners son of the house Brett was and has caused me great grief and my brother to he lost his stuff.
    and to your question no convictions have been made so I guess I have to wait for the FBI to look at each computer, I wish they knew ahaed of time before the warrant, I kinda think the whole thing was a cash grab, grab anything worth money, funny how they took my 20' LCD that hold no information, but left all my DVD's and VHS tapes their that could hold information. As i said Brett will get whats coming to him and hopefully me and my brother will get our stuff back.

    The problem here is that the entire apartment would have only one routable IP Address. The router assigns specific addresses to each computer and device attached to it, true, but those are internal, unroutable IP Addresses, and they change frequently as you attach new devices or restart computers. The police have no good way to determine which internal IP Address received the illegal data, as far as I know. They would have to seize every single piece of hardware that could be used to obtain, transmit or store the data. As for getting your equipment back, contact the police department and request instructions for doing this. Unless the police actually found something on your machine, or have a reason to think your machine was involved somehow, you stand a good chance of getting it back.
