    Default Roommate Won't Move Out

    My question involves a roommate in the State of: New York

    I currently live with my fiance and her old roommate. My fiance and her roommate are on the lease, I moved in at a later date and am not. Prior to my move-in, the terms of our apartment sharing, including the roommates move-out date, were verbally discussed. We do not have a written roommate agreement.

    Now the situation has become acrimonious between my fiance and I and the roommate. Furthermore, the orginally discussed move-out date for the roommate has passed, and she has no intentions of moving out.

    The current lease runs out soon, and my fiance and I had intended to renew it for ourselves ONLY. Does the roommate have any rights to this apartment? Is there anyway to legally force her out?

    How about talking to your landlord about moving to a different unit within the complex at the end of your lease term?
