    Default Eviction of Those Not on the Lease

    My question involves landlord-tenant law in the State of: michigan

    i have a house i was renting on a month to month basis, with legal documents signed by the tenant. i included on there occupancy could include "2 other people". i had to evict the tenant and that was resolved with proper court procedure, and the tenant moved by the eviction date. i am having problems with the "2 other people." they are claiming that they dont have to move out, and refuse to move out, as their names arent on the month to month lease agreement. am i going to have to go through more court proceeding to get them out or should i have the right to send them on their way through the proper authorities?

    If they're merely occupants, not tenants, you should be able to evict them based upon your order against the tenant via a writ of restitution. (I'm assuming that by "proper court procedure" you mean that you obtained a judgment of eviction.)

    Assuming that to be the case you should be able to pursue the tenant for the associated costs; if his occupants aren't out he has not restored you to possession.
