    Default Felony Weapons and Assault

    My question involves criminal law for the state of: Florida
    i know a person who has been charged with AGGRAVATED ASSAULT W/FIREARM, DISCHARGE FIREARM PUBLIC. the officers didnt recover a gun or the bullet they said was fired from a gun when they was at the scene.. they didnt arrest the person until a few days after the incident happen..and the victim/witness in this incident has moved out of the state and dont have any contact info. the victim/witness also said that only a argument happened and a gun wasn't present.. is this case strong enough for a conviction ?

    Somebody told the police that a gun was present and, apparently, that a gun was fired. You've told us nothing about that evidence.

    there is no evidence.. when the incident happen the victim/witness said to a officer they thought they saw something that look like a gun but it turned out to be a shinny metal back of a ipod touch, they didnt find that out till after the arrest.
