Porno on Kids' Computers and iPods

My question involves child abuse or neglect in the State of: Florida.

My ex-husband and I divorced after 6 years in 2005 with a standard Agreement: Shared parental custody, mom as primary residential parent with father getting 4 nights every other weekend.

Soon after divorce, mom was picking up from school for dad and taking care of kids while father was at work to the detriment of mom's job. Money was tight for father and mother and mother did not want children in aftercare.

Next, father stopped paying half of camp stating it was childcare and he was not liable for it.

Father loses job and begins to deteriorate mentally.

Next father stops paying on life insurance and health insurance for kids and all sports of school supplies.

Next father stops paying child support and children begin begging to not go because "dad passes out all the time." Father doesn't feed them, because he is sleeping. Father locks doors to his bedroom after children wake up to find him naked.

Children find photos of penises on their IPods, then a suggestive photo of their father on a family camera, and then find porno on multiple tabs on their computer. MALE ON MALE. The children are 7 and 10.

At that point I file Termination of Visitation motion and call DCF. Nothing happens and as soon as school starts, father shows up at school to try to pick up. Father sends response: MOdification of Child Support (to nill) and that he DENIES all porno stuff and their is no proof and he wants MORE TIME with the kids.
I find the email where Father admits to porn on Ipods and such and apologizes. HE HAS COMMITTED PERJURY.
What chance do I have on an Emergency Motion to Terminate Visitation to REMOVE HIS RIGHTS in return for waiving all past due and future Child Support?

Should we infer that you have already taken your claims about pornography to court, and the judge found that your claims weren't credible? And that now, after the hearing, you have found an email that apologizes, and you want to reopen the matter? First, depending upon the content of the email, the apology may not constitute any form of admission of wrongdoing - we can't read it from where we're sitting, so why don't you tell us what it says? Second, if the email was available to you at the time of the earlier court proceedings it will likely be difficult to reopen the case as it's not new evidence. Talk to your lawyer.

If this has already been litigated, what's your basis for believing that this is an appropriate matter for an emergency motion? And no, "I'll trade you custody for waiving child support" is not the type of relief you request from the court.

Hello and thanks for your reply. No, this case has not been litigated. I filed the motion for Termination a few months ago, and then called DCF a few weeks ago and am writing to see IF I should get an emergency motion for Termination and will the email which indeed admitte to the wrongdoing. Things simply cannot return to "normal." Visitation MUST end so father can get serious help. Please advise.
