    Default Green Card Holder Married to a Foreign Citizen

    Hi everyone,

    I'm a green card holder. One of those old ones that never expires.
    I married a foreign citizen here in the US last year.
    She has never overstayed any of her visit here in the US.
    Bringing her here legally takes about 5 years or so, if I understand it right, because I'm not a citizen here.
    My question is: Are there any special circumstanses when a couple don't have to wait out that 5 years separated?
    Any input is appreciated.

    Only one. When one becomes a citizen.

    Thank you for the answer.
    The reason I was asking such a question, because I'm reading all sort of things on the internet. I also know a person who -because of medical issues -
    worked with an attorney and his wife got her permanent stay here way before the time was up.
    So there has to be other ways also. So I'm thinking!

    If she is qualified, she can find an employer to hire her and file for an H1B or L1 visa. Both of these permit immigration intent. Other than an act of Congress or a very unusual humanitarian waiver, that is your best and likely only option. With immigration intent, she does not qualify for a student visa.

    You really should have investigated this issue before marriage.

    Hi Allshades,
    Why dont you petition her now under F2a (Family based -permanent resident petitioning a spouse) its faster now as per October visa bulletin they are processing April 2010. I just recently knew about this so I'm also applying for my hubby as well. We dont need to wait till we become US Citizens. Hope this info helps.
