    Default How Much Time Do the Police Have to File Drug Charges

    Heres an example:

    A buddy of mine was pulled over by an officer for no apparent reason. When they pulled him over a lot more police officers pulled up to the scene. He had 5 lbs of marijuana in the trunk. My buddy when then taken to jail, questioned and released the next day. They didn't give him no paperwork, just told him it was pending further investigation. This was two years ago. How long until they can bring that case back up or do they feel like it can not be brought back up since he was pulled over for no reason?

    Odds are that if the prosecutor was going to authorize charges, and there isn't some sort of agreement between the defendant and police or prosecutor (e.g., acting as an informant, cooperating in another prosecution) the charges would have been filed by now. For most Michigan felonies the statute of limitations is six years.

    If he was arrested that would trigger his right to a speedy trial. I would think,since he spent the night he was arrested.
    It's possible they didn't pursue the issue because someone screwed up.Maybe no probable cause for the stop and again for the search.
    If there was no arrest then they have some explaining to do for the lengthy detainment.
    He may even have a lawsuit (depending on the circumstances)if time hasn't run out and he's brave enough to disregard that 5 lbs.
