My question involves landlord-tenant law in the State of: Virginia
My daughter signed a lease for an apartment last June. She needed student housing and wasn't going to move in until the beginning of the fall term, whereas the 2 roommates, also students, would be there through the summer. At the time, my daughter asked if they expected her to pay 1/3 of the rent during the summer when they were there but she was not, and they said "No".
The year came and went and my daughter moved out May 7, the last day of classes. The other 2 roommates stayed on until the lease was up June 14.
Much to my dismay, the roommate whose name is on the utilities demanded my daughter pay 1/3 of the utilities for May and June. He very well may have forgotten the issue was discussed back last June as he would have told her anything to get her on the lease. However, regardless of what he remembers or doesn't remember, it's my understanding that students who choose to stay in an apartment over the summer customarily pay their own utilities.
I believe the extent of my responsibility is to pay utilities pro-rated for the 7 days my daughter was in the apartment in May. Am I right or wrong?
