Burglary 5 Years Ago

in Miami, FL - If a buglary victim knows who commited their home burglary and contacts that person over the phone. The victim advised the person they knew they stole the items.. then treatended that they would call police if they didnt sign a 10k dollar promissory note to pay for the stolen property.

So the accused agrees to pay in installments each month out of duress... 5 years later.. the person paying the promissory note cant pay the debt and is facing threats from the victim to take it to court. Can the victim still charge with burglary even though the promissory note doesnt specify there was a burglary? No police report was filed - to the burglars knowledge.. is there a way to find out there was a police report filed? thank you for your time.

Nothing is stopping the victim from contacting the police. Even if we assume the statute of limitations has not run, though, after five years I doubt that the police will be very interested in trying to build a case.
