    Default Divorce and Child Support

    I have a friend who is scheduled to go their divorce trial next week. He met with his lawyer, wife lawyer and mediator last month. The wife went to the state for child support a few months back. He was late in paying due to his job. They made a verbal agreement to have all back pay at the divorce trial. If he does not have all the money will that stop his divorce from being finalized? Can he make an arrangement with the state Child Support to make payments?

    If he doesn't pay off his support arrearage, the court can be expected to order him to do so. He may be able to arrange to pay off his arrearage by having his child support payments increased (so he would pay the current payment plus a portion of the arrearage). He should discuss this with his lawyer.
