Well here is an update, I was at court today for 2 Family Offenses and Paternity. She claimed she was sick as soon as the judge called her on the phone (she has a doctors note for strict bed rest until baby is born). But the judge did not let her go until he went through each case quickly.
I told the judge she told doctors, hospitals, her child guardian, our families that I was the father and she was with me 24/7 except during that time period. And when the judge asked her if I was the father she said yes I was the father after a long pause, and then he granted an order of Filation, I was pretty shocked. Even the clerk was confused with what the judge did, she tried to tell him you know baby is unborn, and he said I filed before the baby is born so he can do it. I asked when that order would take effect on the day the baby is born, and he said yes.
Also the judge asked if I agree with the order of protection against me and I said I did not agree and her claims were baseless in her petition and it was just a retaliation on her part because I turned her in to CPS and about her lying in court. He asked her if she agreed or understood my petition and she said she did not really understand when the judge asked her. Coming back in 5 weeks for that, I will have an attorney by then one way or another.
The judge did update the oder of protection so she can call me to tell me when the baby is born. She asked how could she even contact me to tell me the baby is born when there are orders of protection against each other. And that is when he said he was changing the order of protection.
I asked to see the baby after she is born at the hospital, but he said no there is an order of protection and I would be arrested if i went to the hospital even if my ex was not in the room. I asked him to update the order of protection so I can see my child after she is born, and he said just come back in 5 weeks, he made it sound like he will do something then. This judge is the one who talked me in to filing the second paternity in his court, I actually think he is trying to help me a little. Also he said he sees so much hatred between us both, and were just going to have to learn to get along, I hope that is the case really I do I tried to make this all friendly before I took it to court at all.
My mom even asked him if she could see the baby at the end when we were ready to leave, and he said of course there is no order of protection against her so why not. I hope at least my ex lets my mom at the hospital to see the baby, but they dont get along well so I dont think that is going to be the case but would be nice, this is my moms first grandchild.
I don't have an attorney yet, but I asked the judge for one and he gave me the papers for a court appointed attorney, and I'm meeting with a local attorney tomorrow for an in-office consultation but she is a little expensive so it is going to take me a few weeks to get the retainer money. Any advice whether is will make a real big difference with a court appointed attorney or good private attorney? or any other advice is always appreciated, thanks.
