    Unhappy Is Petit Larceny Going to Ruin My Life

    My question involves criminal law for the state of: New York and Florida.

    I was given an AOCD for an offense of petit larceny on May 3, 2010. The case is due for dismissal on November 3, 2010. After this date, I want to apply for National Certification in my profession, and then a liscence in my profession in Florida. I am worried that even though the case is being dismissed, that there may still be some way that the National Certification Board and the Florida State Board could uncover my charges. Is this a valid concern? If so, Do I have any options?

    Depends on the disclosure requirements of the Boards.

    According to New York Criminal Procedure Law 160.50, the case should be automatically sealed at dismissal unless the prosecution puts for a convincing argument that it is in the interest of justice to leave it unsealed...which I doubt they will even try for petit larcent. From that point forth, the case will only be visible by you, your designated agent, police or the courts. That would effectively make the case disappear.

    Now here's where it gets interesting, from the viewpoint of someone unfamiliar with NY law. If you grant the Boards permission, via written form, to do a background check does that constitute you appointing them your agent?
