    Default Landlords Kept Deposit

    My question involves landlord-tenant law in the State of: Alaska


    So here is my problem, I lived in this place for over a year. I am a clean person very clean i might add.

    Hubby is in the military, so we had to move to texas. gave orders 3 month notice in advance we'd be moving and a written 30 day notice a month before move out. Landlords seemed very nice friendly scheduled a walk through told us every thing looked great. off there way told them we'd call them with forwarding adress.


    week later get to texas forward our mail and leave voice message on there phone as to were to send deposit this was a three weeks ago and a couple other times

    so after 15 days of no calls we decide to call them about our deposit, here is what we got we are not getting one. i asked them where the itemized reciept they told us they sent it to thier rental adress. and that we would not be getting one because it was a no smoking rental and it smelled like smoke so they had to reclean the carpets(mind you i had them proffessionally cleaned and provided them with a reciept) and paint the entire house. mind you my deposit is 1500 and i have never once smoked in the house. And i am telling the truth i have a almost 2 year old and i do not like smoke smell or ciggerettes, have only taken 3 drags at age 16 and about died lol.

    I am a non smoker, however my husband does smoke but outside only. I told them this and that funny none of my things furniture has ever smelled like smoke and nor was there any nicotene stains on floors or walls and they told me it came in through his clothes mind you we wash several loads of laundry a day baby plus uniforms daily. i told them the house always smelled good and when you did the walk through did not mention this to us. and then they began to talk about also an oil spot on the asphault drive way. and that there where not giving us our deposit.

    my problem is when they did the walk through there was no paper we had to sign nor did we take any pictures because we thought every thing was in good condition same as when we recieved the key and they had verbally told us it was everything had to be fine. Just because they wanted to paint their whole house i shouldnt be the one forfieting 1500 dollars and just cause were in the military and moving out of state they have taken advantage of us

    so my question is can they do this and what can i do since i dont have any evidence?
