    Default Responsibilty for Chapter 13 Plan Payments After Filing for Divorce

    My question involves divorce in the State of: Texas. i am currently seperated from my husband and i have filed for a divorce do to alienation of affection and verbal abuse. we filed chapter 13 jointly last year qualyified for disabilty this month. Do i have to pay on the chapter 13? Also we moved into a home my brother bought that was to be paid off in 5 years if we divorced it would get paid off. He signed a promissory note agreeing to this will this hold up in court?? im i eligable for spousal support since he left me with no money closed the checking account.

    We have been married 2 years. He is 48 im 33. He makes 65,000.00 a year and I am making 0 right now

    If you and your spouse don't make the payments required by the Chapter 13 plan, you can expect the bankruptcy to be dismissed and to again be subject to the claims of your creditors. You should discuss your situation with your bankruptcy lawyer.

    my brother had my husband sign a promissory note stating that my brother was going to buy a home for my husband because my husbands credit was so bad he couldnt buy one. The note states that my husband is to make the payments on the house and should he miss one payment my brother could make him vacate the premisises but my husband is still bound to pay the rent and should he get in a bind he can use his retirement money to pay the house off. My husband and brother both signed and had this notarized my husbamd has since abandoned me and the house and stopped payin the rent. So again i ask is this promissory note binding?
