    Default Trespass "Violation" New York

    Hi...

    My daughter, who is 19 years old, was hanging out with some friends at the local high school at night (Nassau County, New York). She received a desk appearance ticket for trespassing, which is showing up in the court's computer system as a "Violation" - NOT a Misdemeanor (sp?). She has to go to court tomorrow.

    My daughter cannot afford an attorney and I am curious if she even needs one for a "violation". And if she does, would a court-appointed attorney do as good a job as someone hired for such a "violation"?

    The desk appearance ticket says she is to go to Arraignments. Does this mean she will only plead guilty or not guilty tomorrow and then have to go back to court?

    One last thing, since this is only a "violation", should she just go to court and plead guilty tomorrow, so as to not drag this out? The police offer that gave her the ticket said that all she needs to do is show up at court and pay a fine - and that would be it.

    We are VOLUNTEERS here. We do have lives outside of this forum.

    Plead Not Guilty, ask for a public defender.

    "Violation" is just an initial classification. Most times one is cited with a violation "ticket", then charged with an infraction, misdemeanor, or worse. Trespassing in most every state is a misdemeanor.

    If she has an arraignment forthcoming, then she's definitely charged with a crime.

    By the way, when one does not get what they percieve as a timely response, you may apply for a full refund!!!

    I just couldn't believe how many people viewed this prior to yourselves and didn't post anything. People come here for help and guidance and when you know your post is being viewed but nobody is helping, it's a bit frustrating.

    The people viewing, like myself for example, may have popped in to read your post to determine if we could be of assistance. If a person can't help, they just leave. The board would be overloaded, and eventually abandoned by those who help, if everyone had to post "Looked but I can't help. Sorry." Some may have come looking, being in a similar situation, to see if you got any guidance to avoid cluttering things up with a new thread.
