    Default Dirty U.A. on Probation - How to Avoid Jail Time

    My question involves criminal law for the state of: UT

    I got a paraphenalia and possession of marijuana a while back. Since it's Utah and my first drug offense (MUI in NV) the di** judge gave me 5 days in jail, $1005 in fines, 1 year probation, and counseling. Counseling was $400 and the probation "officer" (Not a cop) is $420 for a total of $1,825 in fines.

    Here is my position:
    I completed counseling but I have been unable to get a job. Nobody will hire me for some unknown reason. They won't say why. I have been unable to pay my full court fines but I have been paying over $100 per month. They said I had to pay $150 in court fines and $35 probation fee per month to make $185. With no job there is no way I can afford this. I have been paying a minimum amount to avoid the warrant list. All I can really do is donate blood plasma for money. I also need to pay off my counseling ($400 and I owe $360).
    After 9 months of probation I finally got a dirty UA for pot. But instead of a court summons for a dirty UA, I got a court summons for 3 things. Dirty UA, failure to pay court fines, and failure for monthly counseling updates. I COMPLETED counseling but I couldn't pay them their money so I was technically not finished. But I did my 16 weeks. Now it's either I pay all my money to the court and avoid jail, or I try to pay some to counseling and go to jail anyways. It's bullsheet they are sticking all 3 things to me.

    My question is this: How do I avoid jailtime? I have been trying, I really have. I have emails about jobs that I printed off and I'm taking them to show the judge I am trying. I wish I could hit a magic button and have a job and pay all my fines and everything would be just fine. But apparently I'm doing something wrong or something is not going right for me. I just want to show the judge I *REALLY* am trying because I have been freakin stressing over a job for a long time. I haven't been buying drugs, *ALL* of my money and money I ask my friends or family for has been going to the court.

    There's no way we can promise you that you will avoid jail time. The judge may well look at you - no job, late on fines (but it can be inferred that you have money for drugs), a positive drug test, and all that after five days in jail - and decide that there's no reason not to send you to jail for a longer period (you have no job to lose) and that maybe nothing short of that will wake you up to the seriousness of your situation. Your best bet is probably to actually get a job.
