    Default Drunk in Public in New Orleans, Live in a Different State

    My question involves criminal law for the state of: alcohol


    After the Saints won the superbowl, a friend and I drove down to New Orleans and long story short we had a very good time and ended up getting arrested in a small town near New Orleans for disturbing the peace:drunk in public. I went to court down there and had an attorney who said he would represent me (and did at the hearing) so I plead not guilty and he said he would take care of it all and I would not have to come back (I live about 10 hours away in a different state). Now, the lawyer I had has become a DA out there and can no longer represent me so I tried calling a new lawyer and they want to charge a ridiculous amount and can't even guarantee I wouldn't have to come back down there. My question is, what would happen if I just let this go to a warrant? How long would it be around and could I not leave the country because of it? In Louisiana it is a very small crime, almost like a speeding ticket and the other people I saw in court that day who plead guilty were just given time served.

    The questions I have are:

    - Would I be able to renew my drivers license in Texas?

    - Would I be able to leave the country without issue (on vacation)?

    - How long would it be before this warrant goes away?

    If you let it go, there will be a warrant for your arrest. Anytime you are pulled over for a traffic violation, you will be handcuffed and taken to jail until the issuing court says whether they want to extradite you. If they don't, you are released and the warrant is still active. Next time you are pulled over/interact with police that requires they run your name...the process will be repeated.


    There is a good chance that you would not be able to renew your license until you clear it up.
    You can leave the country and maybe you can come back without problem, maybe not. Now if you're just talking about running south of the border, the chances of problems are slightly smaller.
    The warrant stays until you deal with the charge or it is quashed for some reason.

    Even though I don't live in Louisiana? I live in Texas, are you saying that if I get pulled over in Texas I will get arrested. It is obvious that they won't drive the 10 hours to get me from New Orleans just for the equivalent of a traffic ticket but I do not like going to jail so if I got arrested every time there is a police interaction, I would prefer to get it taken care of.

    Yup. The warrant should be entered into NCIC, which is one of the databases your information is run through whenever you have an encounter with law enforcement that necessitates them running you. You may not necessarily go to jail. The issuing court can notate the range they are willing to travel in the NCIC entry. If you are outside it, you'll just spend a few moments in cuffs in a police car while they figure that out. I do not know to what lengths the court will go to secure your arrest.
    Best thing to do is get it taken care of.
