    Default Texas Eviction Due to Judgement, What Happens to Personal Property

    State: TEXAS

    Case: Roommate has been evicted in court due to judgement and has left belongings in the premise.

    Question: What happens to evicted roommates personal property?


    I have won an eviction against a roommate in my house. I evicted the roommate because I have not seen the roommate in 2 months. Of course their belongings are still in my house. Today is the first day that the roommate has a chance to appeal. I doubt the roommate will appeal because the roommate didn't show up to court. So what options do I have to have his belongings removed?

    If you have an order of eviction that allows you to remove the roommate and his property from the premises, you can act on that judgment once it becomes final. Typically you either get a judgment permitting eviction that becomes final once the appellate window expires, or you get a judgment entitling you to get a subsequent order to remove the tenant and property but cannot apply for that order until the window for appeal expires. It's my understanding that a Texas landlord can execute a "Writ of Possession" starting five days after getting a judgment in his favor on an eviction case.
