My question involves a traffic accident in the State of: Arizona
I recently backed into a parked vehicle in a parking lot. There was no damage to either vehicle, but it was his company truck so a police report need to be filed. I agreed and an officer came out. I ended up being cited for improper backing.
I plan on fighting the ticket as I don't believe I can be cited for this on private property. Am I wrong?
I did not leave the scene
I was not under the influence
The was no damage to either vehicle
Nobody was injured
I did some research and also found out the following, which I think will be my plan of attack.
Chapter 3, Article 2, 28-621 states:
The provisions of this chapter and chapter 5 of this title relating to the operation of vehicles refer exclusively to the operation of vehicles on highways except:
1. If a different place is specifically provided by statute.
2. Article 4 of this chapter and section 28-693 apply on highways and elsewhere throughout this state.
My violation, which is part of Chapter 3 states this:
28-891.a -The driver of a vehicle shall not back the vehicle unless the movement can be made with reasonable safety and without interfering with other traffic.
Am I on track or way off? Thanks
