    Default When Should a Judge Exclude Herself from Sitting on a Case

    ALABAMA

    Should a judge who is sitting on a hearing pertaining to a divorce decree in which one of the petitioners is a business acquaintance due to them being a former district attorney, and lawyer, excuse herself from hearing the case?

    She did not and refused and or=verruled all motions made by our attorney.
    Is this legal or should we file a complaint and ask for a retrial in another venue?
