    Default Co-Signer's Remedy When Primary Borrower Defaults

    My question involves an auto loan or repossession in the State of: Maryland

    I co-signed an auto loan for my roommate and they have skipped town and refused to pay the loan and insurance. The registration is in both of our names. I am unable to use the car. What can I do to get the car back/sell it back to the bank, etc. (Short of reporting the car stolen)...Any help will be greatly appreciated!

    If the title is in both of your names, you both own the car and you both have the right to possess and use it - that is, it's hasn't been stolen.

    You are free to sue your ex-roommate for the money owed to you.
