My question involves a traffic accident in the State of: GA
Hi, I am hoping you can help with a question on fault of accident.
Road has 2 lanes going east, 2 lanes going west, each direction also has a right hand turning lane, and there is also a shared center turn lane.
It is rush hour, and all lanes are full and stopped for a light which limits sight across lanes.
Driver #1 is traveling west in the right hand turn lane, which is supposed to turn into a parking lot. However he intends to go straight to turn at light just beyond the parking lot turn, although he is not past the parking lot turn spot at the time of the accident.
Driver #2 is traveling east, and makes left hand turn into the parking lot entrance. Both cars collide in turn lane of the parking lot intersection, the impact is to the front of both cars.
Driver #2 also has a 1 day lapse in insurance in a state in which it is required.
How is fault determined in this accident? Is driver #1 wrong even though he had not actually missed the turn spot yet? Was driver #2 wrong in making left hand turn when the intersection was not clear? Does lack of insurance have a bearing on determining who is at fault? Are both drivers equally to blame?
