    Of course not. I know someone that was arrested for 1st degree burglary but now the person who accused him of the crime wants to retract what they said the night it happened. Instead of the person breaking into the house the person was invited into the house. Tempers flared during and arguement and there was a hole punched into a wall. The victim is now not wanting to go to court to testify.

    Since it is not really possible to "retract" a statement, about all they can do is go to the police and the DA and ask that they drop the matter. Maybe they will, maybe they won't. if they do not drop the matter, then he should be prepared to testify truthfully as to what happened.

    That's a HUGE difference. So, if this guy is now going to testify that he LIED to the police he can find himself going to jail at the same time as the accused burglar gets out. The cops really do not like being lied to.

    The "victim" should consider consulting an attorney before he goes ahead and confesses to making a false report to the police.
