    Default High School Party Rape

    My question involves criminal law for the state of: Florida

    Long story short, my cousin recently graduated from high school. He was going to a party thrown by a friend who had managed to get alcohol one way or another. A girl who he had a big crush on was there and the combination of booze and teenage hormones went it's usual route.

    According to my cousin, both were quite intoxicated, the deed was done in an up stairs bedroom where the party was. After they were done, both went back down to the party and there wasn't any kind of scene then.

    My aunt got a call earlier today from the girl's parents saying they plan to file charges against him. So in short, what advice can I give them, other than hire the best attorney they can?

    Oh, and he is 18 and she's turning 18 next week, so there isn't any kind of sex with minor charges involved.

    that's about it.

    If she was intoxicated, she could not consent to sex. It can be considered rape. I have seen situations like this prosecuted. Seen the DA refuse to prosecute. Depending on all of the facts, the DA will decide one way or the other.
