My question involves collection proceedings in the State of: PA
HELP! I am so confuse. My husband and I file for Chapter 7 bankruptcy Jan2010. He lost hours at work and we had no other way out. We were discharged at the end of June 2010. We have a parent plus loan that we attained while my daughter attended college for 4 years. This we understand could not be included in the bankruptcy. But we also have another loan that we applied for in 2004 through KeyEducation. This was for my son who was diagnosed with dyslexia. The school system in our area was letting him fall through the cracks and so we placed him in a private school that helped taught children like him to read and right. He was 13yrs. and going into 8th grade and could not read or write. We thought that this loan was consider a private loan and could be included in the bankruptcy. It was not. It was consider a student loan. I thought that a student loan was a loan that was attain for college or any higher education. How can a loan attained when my son was entering 8th grade be consider a student loan? Our original loan was for $14,178.00. We still owe $11,846.34 (as of 8/9/2010). The interest rate was any where between 4.14 and 9.27. I asked for a copy of the transaction history on the account and they send us a not so informative, one sheet, transaction report. Please help!
Is this still consider a student for an 8th grade student. And,
Why does our repayment look like we have not been paying. We did stop paying last year around Dec. 09, due to financial difficulties. Who can I turn to that can maybe negotiate a fix interest rate with this KeyEducation? They did charge-off the account.
My son can now read and write and is going part-time to a community college, thanks to the private school.
