    Default Tenant Breaking Lease

    My question involves landlord-tenant law in the State of: Wisconsin

    My wife and 2 children rented a house and signed a 2 year lease in a house. when we moved in my older daughter was going to have her bedroom in the basement but there were no windows in it only one door out. A verbal agreement was that the landlord would put a window in and rent the house as a 3 bedroom not a two which legally was only a 2. Anyways we lived there a year and he never put the windows in we had to stay there for the winter cause who wants to move in the winter and we were never late on our rent. We contacted the state of wisconsin and they gave him a formal complaint I still have the letter.we decided that we wanted out of the lease so we emailed and called him at least 4 months before we planned on leaving he refused to let us out. Also we decided to get a divorce and one of us could not afford to stay there alone.He is trying to get us to pay the full next year.it was 1000 a month. What can I do legally if he brings me to court?? Thanks for the replys...

    Does the lease in fact say that it's a three bedroom unit?

    Was the 'formal complaint' for renting a two bedroom house as a three bedroom house, or for knowingly letting an occupant use an inappropriate space as a bedroom? How was it resolved?

    If the lease says it's a two bedroom unit, which by your account it is, and only one or two people will be living in the house, the code violation issue would appear to have been resolved.

    no he rented it as a 3 bedroom because he knowingly knew our daughter was living in the basement with no windows and verbally agreed to put windows in thfirst couple months we started to live there and never did put them in for a year and we decided we wanted out of the lease...
