    Default Unknowingly False Police Report

    My question involves criminal law for the state of: NY

    Hi all, this is a strange case.

    One late night, I was in an dark area around a university on pubic biking land, just enjoying the breeze and listening to my music. Then I was knocked unconscious and had my ipod stolen from me. I woke up a few seconds ( minutes) later and called the University security ( i am a student there)

    I told them how I was robbed and everything. So I went to the hospital and got a cat scan. I had a concussion but not a bad one ( no bleeding into brain)

    At that time, I gave campus security and the police the report of what happened. I truly believe that was what happened.

    I was discharged the next day and these investigators for the university called me and wanted to interview me. During the questioning, everything was like normal. Then, they started suggesting that maybe I wasn't telling them something and that maybe I was lying and made up the story. All of a sudden, as I was pondering this, I blacked out again. Ambulance came and said I had really low blood pressure and that it was probably caused by the concussion.

    Now here is the weird thing, after I came out the of blackout, I am not so sure what really happened. Was I really mugged or did I have a black out? ( i do have a history of black outs and my heart is a bit abnormal)

    After more grilling by the investigators ( basically they want to cover the thing up, they were like " if u lied, you can tell us now or we will have to investigate this and we have hidden cameras all over the place on campus, and also you know that the school year is starting soon and we don't want parents to worry about students getting attacked near campus)

    so after everything, i was more confused than ever. I really don't know what happened and I know brain injuries can be really tricky

    So in the end, they made m sign a statement saying that I do not remember what happened, I could have been mugged or I could have just blacked out and hit my head and somehow fabricated the story ( a few weeks ago, I was approached by someone who fit my story who wanted money from me and was kind of hostile) so they were saying, maybe I incorporated him into this current incident.

    What do I do now? I seriously am very confused.

    Since when does blacking out result in the disappearance of your ipod?

    Whether you blacked out or were attacked, either way you WERE victimized. Either someone struck you with a physical attack, or someone saw that you passed out and approached you to victimize you for your property. Either way, campus security has a problem. They have a campus reputation to protect, and sadly, many schools are willing to sweep attacks on students under the rug and hush them up. Stop talking to campus security, speak only to the police, and I'd be on my way to an attorney ASAP, and asking if the school may have any liability (was the area where the incident occurred well lit, how come checking security tapes wasn't the absolute FIRST thing that happened....a good attorney will see a LOT of things wrong here). Check your local listings under "personal injury", and speak to more than one since many will give at least an initial consultation free of charge.

    Thank you for the reply.

    basically, the college investigators were like" hey, we know u are a student and we know students are stressed out. If this is a call for help, we understand. We have incidences in the past when students make things up like this."

    Here are the facts:
    1. I had a concussion. That can't be denied
    2. They did find low blood pressure and I do have a werid heart rhythm
    3. I do not have my ipod anymore ( either it was stolen or it was lost since the area had tons of weed, and is beside a lake)

    4. I blacked out again RIGHT IN FRONT of those investigators. Even they said they were scared that I was really hurt)

    So basically, I was stuck between a rock and a hard place. They were saying, if I 100% say that I was attacked and it was found out later that I did make up the assult, I could be expelled from school and be charged with making a falso police report.

    Or if I confess now to making up the assult , the school won't expell me and they can talk to the cops about not investiagting but no guarentees.

    IN the end, I was tempted to say I made it up, but I truly don't know why the hell would I give myself a concussion and rack up ambulance fees?

    And the thing that makes me wonder is where the guy that assulted me went, there are cameras everywhere in that area and there is only 2 way out.

    sigh, it sucks to not know if your own mind is tricking you.

    Any advice would be great!

    No more talking to police or investigators unless and until you get a lawyer. Talk only to your lawyer about this situation from here on out.

    As to the legal aspect aardvarc's advise nails it down well.
    No ipod says crime.Whether it was a mugging or pilfering.
    Signing the statement might have a slight negative legal effect,but I think your honesty and willingness to tell them you don't know will help more than hurt in the end.

    I know the stress caused by not knowing what happened.
    Low blood sugar,stress and dehydration can cause many wierd symptoms.
    I can tell you from the medical standpoint that your mind can create scenarios if it does not comprehend what is happening.Not comprehending is simply not an option.Just as your eye fills gaps so does your brain.

    Was there a physical lump on your head or soreness?
    Did you think you saw someone.
    I had the same thing happen to me 15 years ago(no crime though).I actually saw an angel creep up behind me and whack me in the head with a 2x4.Then I remember passing out.
    I was alone so I don't know how long I was out.I knew after I woke up I hallucinated the whole thing.I was probably already passed out when I saw this.It made perfect sense at the time I saw it though.
    The angel looked like one from the movie "angels in the outfield".
    I had 4 small children at that time and had recently purchased the VHS(remember those?) "angels in the outfield".My kids watched it over and over.

    I was lucky to be able to figure out what happened which makes it way less freaky than what your going through.
    It was stress,dehydration,working 12 hours a day with large hot running machinery in an enclosed environment.
    Oh yea,way to much caffeine.
    So don't get to freaky about it if you have been under alot of stress.I changed my lifestyle and it never happened again.
    Definitely follow up on aardvarks and Buddy's advice.Also PLEASE see a doctor and watch those energy drinks.

    I didn't mean to imply that you hallucinated the whole thing but I just wanted to tell you it can and does happen.
    No ipod really bothers me.No lump/pain makes it a mystery.
    I believe you did not make it up.
    Keep in mind it is not illegal to hallucinate.

    First was your iPOD gone when you awaken? Yes. So it was not your imagination.
    Second my brother has that problem and he's under the care of a cardiologist since 15, he's 24 now. Says his heart beats so slow at times that it causes a lack of oxygen to be carried to the brain through his blood.
