DH Divorced and Court Order in CT back in '96
ExWife moved kids all over the country and ended up in Cali

Kid in question is 18 and is IN the Navy

Dh got a medical support order notification from California where SS18 was living until he joined the Navy. They have already garnished dh's pay. DH was never co'd to pay insurance unless he had a job that provided it. Well he never had a job with benefits until May. Kid was on his mother's and stepdad's (Army) insurance until he enlisted in the Navy. DH paid his child support and whatever extra the ex wanted for insurance stuff, although I thought Army insurance was free. But she'd send receipts w/ the amount circled and dh always paid his share.

We live in CT and the kid WAS living in Cali but he is in the Navy now based in Illinois.

DH finally heard from California - they agreed that DH's youngest son SS18 is emancipated since he is in the Navy so someone messed up and the kid doesn't fall under the Medical Support Order. They sent the paperwork to our company benefits dept. DH has already had money garnished from his paycheck of 7/30/10. They signed him and SS18 up for PREMIUM insurance as of 7/12 and we had no idea until 2 weeks ago - nobody told him NOTHING until he received a letter from the company bene's dept saying they already signed dh and the kid up for insurance. DH normally was on MY insurance so he never needed any.

He called our benefits dept. on Monday and they told him they received the corrected paperwork from California saying that SS18 is emancipated but have 15 days to review the file which is 28 pages long. DH has not seen any documentation on this. The only documentation he got was a wage garnishment notice and his paycheck was garnished starting 7/30/2010. DH asked if his paycheck would be garnished again and our benefits deptartment said more than likely until they review and he can check back on 8/15/2010 (which is another payday where his paycheck will be garnished yet again). DH asked who is going to reimburse him since someone made a mistake and our benefits department doesn't think it will be them. My questions are, do we wait until 8/15 to find out what our benefits department says and who is responsible for reimbursing him - bene's dept. or State of CA? Someone messed up so why should DH have to throw money out the window for this and why didn't he receive ANY documentation on this?

Is this worth chasing or should we just pretend dh is flushing money down the toilet and that is the way it is?
