    Default Guilty by Association

    My question involves criminal law for the state of: Pennsylvania

    Last sunday I was at a party and the cops came into the house because they were smoking Marijuana. The door was open so they had the right to come in. The owners of the house fled thru the back. I had been drinking (I am 23) though not visibly toxicated or drunk. I had not been smoking and have not smoked in the last 7 years.

    The cops come in and told the kid with the blunt to put it away. Then some people fled but having dealt with cops before (two underages that I am trying to clear up now) I just stayed put and didn't say a word. The cops asked for IDs so I gave him mine. The cops asked me who lives her and i said "This is the first time I had ever met these people as I cam to this party with my friends and they left only minutes before." Cop asks me to sit down. One of the people who didn't run was giving the cop a hard time and the rest of us were looking at her like "shut up"

    Cop ends up searching us after he looks thru the house for a gun. I have nothing on me and the kid with the blunt had a small baggie of marijuana on him.

    We end up sitting there for a few more minutes then the cop calls me in the back to question me. He said, "your one friend is going to get into a little trouble for the small bag of marijuana" He then asks me who the guys were that ran. I said i just met them tonight and all i know is the bigger guys name is X. I then explain I cam with some friends before who just left and I was in the middle of a conversation and was about to leave because I do not like the smell of marijuana. He said ok you are free to leave. I then walked out the front door and back to my house.

    In the past when I received my underages / drunk in publics the cops had to drive me home and put me in the care of someone else. They also did not breathalize me. I am worried that the cops didn't cite me that night but are waiting to close the case before they site me. I called the officer and left a voicemail but he hasn't called me back (that night he said i was very cooperative). I know in the past a week later I would all of a sudden get a citation in the mail. Can I get in trouble for guilty by association? I was not smoking and would rather take a drug test now to prove it then have them tell me i was smoking a month later when the case is closed and the marijuana would be out of my system anyway. Help please!!

    They didn't cite you, so odds are they won't. I suggest that you relax, ideally without the aid of illicit substances, as worrying won't change the future.

    Calling the police is not gonna help matters any,since you were of age,respectful and not smoking it proably helped you out.
