    Default Applying for K1 for Illegal Fiance in Another Country

    Hello, my situation is a bit complex and will try to briefly state it here. Any advice would be greatly appreciated. I met my boyfriend/fiance 4 years ago in France. We have been dating ever since and I have all documentation to support that we have been together for that long. The issue is that he is illegal in France. We were thinking of just waiting for him to get naturalized in France (2012) but at this point, we know we want to be together... If I apply for a K1 since he is not legal in France, would he even be able to get a visa from the American consultate in France? I don't think he'd even be approved for the visa, since I'm sure it is more than frowned upon that he is illegal there. Does this mean that he would have to go back to his own country (Algeria) and I apply for the K1 visa to the US embassy there? The issue would be that I have never been to Algeria and Algeria is considered a "terrorist" country and thus his application would probably be much more scrutinized. Then they would know that I have never been to Algeria (even if I go now, it's way too short a "dating" period....) but if we say we met in France, they'd know he was illegal...

    I'm not sure what my options really are but we're just tired of being away from each other and I don't want to move to France. Is it possible for me to apply for a K1 for him in France, when he's residing there illegally?

    Why can't he travel to Algeria for the interview? It's too hard to sneak back into France?

    he can go back to algeria if needed, but would they even approve his visa when he was illegal in france? we wouldn't want him to go back if he wouldn't get approved for a K1 visa from the US and then lose any chance of getting naturalized in france by just staying the 1 - 2 additional years... would the US even think to approve his visa when he's illegal in another country? doesn't seem like a good reflection on his part... any guidance, i'd be grateful.
