My question involves criminal law for the state of: Iowa
I went uptown with a friend to see a live band and had a few drinks. We ended up at the bar where I started talking to this guy. We got pretty drunk and walked across town to his house(the guy I met at the bar). On the way we got into an argument and he threatened me and pushed me. I hit him a few times so he wouldn't want to push me again. I helped him up and he apologized for pushing me. We hugged and continued on to his house where he played guitar and my friend played his piano. We said our goodbyes and my friend and I walked back across town. I had my dad give us a ride to my friend's place about 30 minutes away where I spent the night. The next day I'm out fishing with my daughter and I get a call from the cops saying this guy wants his doctor bills paid and wants me to return 2 guitars that came up missing that night.
The guy admitted to mouthing off to me, and a neighbor saw the fight but didn't see us take anything. He told the cops that he didn't notice the guitars missing until he got up in the morning (after we were gone) and went to the hospital. He also told the cop he invited us in after the fight. I haven't been arrested yet. The guy says he wants his stuff back and bills paid or he's pressing charges. I can't give him his stuff back because I didn't take it. I told him I will pay his medical bills just to keep from getting arrested. He has a broken nose and nine stitches in his lip. I feel like I'm being extorted!
Is this enough to charge me with theft?
Can I be charged with assault if he admits to starting the fight?
