My question involves traffic court in the State of: WASHINGTON
i know, i know. no such thing as a slam dunk.
I have court on Monday 8/9/10 which limits the amount of time I would otherwise have to possibly obtain radar operating manual, speedometer calibration policy, etc.

Background: I was traveling East on Highway 2, just came off the trestle from Everett. As the report indicates the cop was traveling same direction ahead off me and clocked me at 72 with his ass radar. As the reports are often heavily templated he indicates that he "visually estimated my speed" and all that but he was at least a couple hundred yards ahead and unlikley to have actually been watching me come around that curve. I slowed as soon as I saw him. And about a half mile plus ahead he slowed enuf to get behind me and pull me over.

I submitted a request for discovery using the template on this forum 14 days before my hearing.
The citation was filed with the court within 5 days. Discovery was provided to me within 7 days.

The radar certificate is on file and looks good.

I could use some help formulating some motions and arguments.
For the most part it looks pretty tight. (unlike the last easy ticket where the officer had hella old dates on his statements that didn’t even match eachother. SLAM DUNK!)

Questions:
1) i dont think there is a law about how often WPS must calibrate speedometers but maybe they have a policy? Cuz this speedometer hasn’t been calibrated since oct 2007.

2) He mentions that "speed in the SMD's display window was verified with the patrol vehicles speedometer." what does this even mean?? I've heard the argument about how he didn’t list which patrol car he was driving (which he didn’t) so how can I check to see if the speedo has ever been calibrated. But two problems with that for me:
A) if the judge asks what the speedo calibration has to do with the radar Im not prepared to give a convincing argument.
B) The speedo calibration documents that the WPS provides on file at the court actually have the associated radar serial number on them. in my case at my courthouse they are in the same binder as the radar certs. So altho they are not in any order (I flipped thru every on looking for the speedo cert, it was the 4th from the back out of a stack of hundreds) I was able to find the speedo cert using the number of the radar device which of course is provided in the officer's statement. I wont be surprised that this judge knows that a person can find the speedo certs this way. Also FWIW I didn’t request a speedo cert in discovery. (I did of course ask for the radar cert and they of course directed me to the court)

3) I spose I'll try the "how can he know that Im the only car in the beam" and I can say that there were multiple cars in my immediate vicinity as he makes no mention of other vehicles in the area. And I think it helps me that he mentions he was 600 feet in front as how can he be sure it was not the car next to me from that distance and on a road that was not perfectly straight and not mentioning which lane he or I was in on this two lane section of highway.
Am I right aobut this? Cuz he says "the vehicle was the only vehicle moving in the SMD's beam"
He doesn’t say I was the only car around.
But if this argument holds water then what exactly is my motion at my hearing?

What else am I missing???
