"Buying" a US visa sponsorship is illegal in the US. This is what you participated in when you paid a visa sponsorship guarantee. Few fees may be paid by the prospective employee - such as attorney's fees for preparing documents - which would not be refunded even if the petition was denied.
If there is not position waiting for you in the US, your employer should not have given you documents for stamping and entry; you have no reason for legal action against him for failing to bring you her to become out of status due to lack of work. You would likely have been denied entry with a notation in your permanent immigration record.
You may have legal action against him in India. You may certainly report him to the USCIS. A report to the US DOL may have some effect.
In the future, do not participate in this type of action. You have no inherent "right" by US laws to work in the US without proper sponsorship. Find a legitimate employer who has jobs for which you are qualified.
