    Default Divorce Decree Orders You to Pay College

    My question involves child support in the State of: Oklahoma

    My new husband has a 20 year old for whom he no longer pays child support. However, his divorce decree was set up to put $ aside thru the years and pay 100% of his son's college. Unfortunately, my husband did not put $ aside, as he lost his company during those years and is only now getting financially on his feet. We have been paying 1/2 of his son's college (but he has been in community college which made it affordable). Now, he is going to a large univeristy and costs are obviously more. We have agreed to pay 1/3. His ex pays 1/3, and his son works and pays 1/3. Question - Can his ex hold my husband to paying 100% for this now 20 year old adult's college education if that is what it stipulated in the decree? His attorney at the time told him the commitment for paying for a young man >18's college was not worth the paper he was sigining. Advice?

    If it's in the decree, then Mom can absolutely hold Dad to the original agreement.

    Many courts have upheld such agreements.

    Just to confirm - even though this child is now 20 and has a job, he can legally expect us to pay 100%? There is not a thing we can do?

    If the decree states that Dad is responsible for X, then yes.

    Dad may be able to have the decree modified to reflect the status quo - that is, each party is currently paying 1/3 hence it's acceptable to all parties and should become legally binding.

    Have Dad speak with a local attorney.

    Not what I wanted to hear, but suspected that was the answer. Does not seem legal to enforce financial parental obligations for Kids (uhm, adults) >18 yrs old. I worked MY way thru college, what's wrong with kids nowadays!? Thanks for the help!
