    Default Stole $2000 From Employer

    I am a former bank teller who was terminated for removing $2,000.00 from another tellers cashbox. I gained access to her cashbox by accessing the key in the dual control key-box. The dual control key-box is a key-box that has a backup key of all keys in the bank. It requires two bank employees to insert their opposite keys to open it. I had the opposite dual-box key from a former employee who quit and her key was never returned to the dual-control key box. I had that key and hid it. I used the opposite key to get the backup key to her cash storage area and took $2,000.00 Friday 7/16/10. It was discovered the cash was missing the following week. Internal investigation showed an image of me entering the dual control key box. It does not clearly show (To my knowledge) me removing cash but I did remove it. I repaid Wachovia the exact amount they were out, $2,000.00 and was terminated. They gave me my personal belonings and I drove home. The internal investigator claimed she filed a police report last Thursday 7/29 and I have not heard from police, seen a charge or been arrested. I am trying to explore my options I am 20, a university student and made a mistake that was paid back.

    Giving back the funds once you were caught in no way negates that a crime took place. It only means that if you're found guilty, they won't have to order you to pay it back at that point. If a police report was filed, that report goes to the DAs office who decides whether or not to bring criminal charges against you for the theft. Since it wasn't a violent crime, the typical order of events is that if the DA decides to file on you, they'll request a warrant for your arrest, and that warrant will just sit out in space until such time as law enforcement just happens to run across you for some other reason (minor traffic accident, speeding ticket, or similar). This is how the vast majority of warrants get acted upon. Despite what you see on TV, police simply don't have the manpower to go looking for non-violent offenders with warrants hanging over them. In some places, they may send you a "notice to appear" by mail, but a warrant is just as common (people tend to flee when they get notice that they could go to jail). The DAs office has until the statute of limitations expires to initiate charges (2 years if the crime was a misdemeanor in most states, and 2 to 4 in most states if the amount means the charge was a felony in your state). If you get such a notice, or worse, get picked up on a warrant, it would be highly beneficial if you've already researched some local criminal defense attorneys and had a few of their numbers handy in your wallet. Until then, all you can do is sit back and wait to see if the state picks up the charge and wants to pursue it.

    No, you did not make a mistake. What you did required thought and effort. Transposing two numbers because you're writing too fast is a mistake. Thwarting a dual security system to steal $2000 is a deliberate action, and any judge that you say "mistake" to is going to say exactly that.

    You need an attorney, and you need one NOW. Even though you returned the money, you can - and most likely will - be criminally prosecuted for felony theft.

    Agreed, from what the OP wrote the intent was clearly there. I'd say the intent started when she kept a security controlled key that she had no right to.

    I agree.

    You make it sound like you tripped over a curb and, when you stood up, found someone else's $2K in your pocket.

    This is a felony... and will be prosecuted as such.

    You should also be ready for this to impact your university studies.
