There could be valid reasons not to prosecute, but I would think that corporate would want to prosecute.

It is possible they want to collect on the civil demand first. Paying the civil demand does not exclude later criminal charges. The charges are only limited by the statute of limitations.

If some of the medications are controlled substances, that complicates things considerably.

A criminal record is not the only thing that will affect future jobs. All major retailers participate in a shoplifting/retail theft database and once a person is in that database there will be no possible way to get a job with any participating retailer which certainly includes every pharmacy chain there is.

I would consult with a good criminal attorney and arrange for representation for whatever happens. If you all don't want your husband to sit in jail for a lengthy period should he be arrested, now is the time to start saving some money for bail or selling unneeded assets.

Also, make sure that you have full legal power over family finances.
