    Default Vacation Cap Rules

    My organization is changing there vacation policy. Vacation accrual will be 2 times your annual accrual rate. I am going from the old policy of 400 hours capped where once you capped any other accrual was paid out at the end of the calender year.

    I am now going to 320 yours capped in the fiscal year and they say they will not pay out any accrual over the cap.

    I am in California I understand that a "use it or loose it" policy is not legal, and a cap is. I don't understand that once I reach that cap what happens to any vacation time I would of accrued. Do I loose it or do they have to pay it out?

    Once the cap is reached, you just don't accrue any more until you bring your balance down below your maximum.

    Do you have over 320 hours available now?

    Yes, I will need to take about 65 hours between now and the end of Sept. when the new policy goes into effect to bring it down to 320 but will have to take more in order to continue to acrue

    Good, because the law does require that you be given "adequate time" to take vacation so that you can fall below the cap and continue to accrue once the new maximum goes into effect.

    I am probably not going anywhere, my wife works budget for the DOD and usually has to work 7 days a week during Sept. but I'll probably get a lot of golf in
