    Question Summons for past debt: confused about "Does 1 to 10"

    I live in California and I got a summons from a law firm representing a credit card company I owe roughly $3000 + legal fees. The debt is over 4 years old. I have 30 days to respond.

    There is a line in the summons that lists the name of the law firm as the plaintiff and my name as a defendant. Then just below that it simply states "Does 1 to 10". What does that mean? Can I be put in jail for past debts?

    I want to pay off the debt and am in a position to take care of it. I would prefer that my wages be garnished to pay off this debt. Should I call the law firm up and just settle that way out of court?

    Please advise.

    Are you sure it doesn't say "POS-010", which would reference the proof of service form the Plaintiff is supposed to use?

    I can't advise you as to whether you should settle, or the terms of how you should settle. If you wish to try to settle the case with the creditor's lawyer, they will probably speak with you and may agree to installment payments. If you can avoid having a judgment entered, there will ordinarily be less damage to your credit.
