    Default Employer Withholding Pay

    My question involves labor and employment law for the state of: SC

    I resigned my job and then was told that the employer was not going to pay me for a week and one and a half days I worked. Later after filing suit against the employer I received the week paycheck but not in the time frame allotted by law. Never received the day and a half pay. Now the employer is suing me because they said I stole passwords, data bases, etc. Needless to say that isn't true. What chances do I have of winning the case against my employer and defending against the one he filed against me?

    Don't know why you sued to get your final wages; you could have filed a claim with the state Dept. of Labor, and you can still do so for the remaining unpaid time with this form.

    If you have been served with a law suit, you need an attorney to review the charges and formulate a defense.

    SC Wage and Labor does not collect money for you. They review the case that you file with them and fine the employer but cannot make them pay you. The only way to get it is to file a claim with the magistrates court.

    OK, so you got a judgment and they didn't satisfy it fully? Or was the judgment for a lesser amount than you expected?
